User Agreement

1. General Provisions

1. This User Agreement (hereinafter — “Agreement”) governs the relationship between:

   • the owner of the “Age of Astir” project, responsible for administration and maintenance (hereinafter — “Administration”, “Project”, “We”),
   • and any competent individual using the services and software of the “Age of Astir” project (hereinafter — “User”, “You”).

2. The “Age of Astir” project server is provided for demonstration and testing purposes only and is intended to showcase the functionality of the software components and libraries developed by the Administration, which may be distributed under open-source licenses or in closed form. Use of the Service is solely for testing and feedback and does not constitute a commercial or consumer service.

3. Access to the Service is free of charge, subject to this User Agreement, and does not involve entering into a paid service contract. Under Article 421 of the Civil Code of the Russian Federation, the Administration is free to determine the terms of access to the Service and may refuse access without explanation.

4. Any use of the Service, including but not limited to: installing or running the Game Client, connecting to the Server, registering an account, downloading software, visiting the project website, or making a Donation, constitutes Your full and unconditional acceptance of all terms of this Agreement as amended at the time of use.

5. The relationship between the parties is governed by the laws of the Russian Federation, in particular the Civil Code of the Russian Federation and Federal Laws No. 152-ФЗ, No. 149-ФЗ, and No. 436-ФЗ.

2. Definitions

3. Subject of the Agreement

1. The Administration grants the User a personal, limited, revocable, non-exclusive right to use the Services of the project “as is” (AS IS) solely for personal, non-commercial purposes, within and on the terms specified in this Agreement.

2. Use of the project Services is permitted only after the User’s acceptance of this Agreement.

3. No provision of this Agreement shall be construed as a transfer or assignment of intellectual property rights to the User.

4. The User acknowledges that the primary purpose of the “Age of Astir” project is to provide entertainment organized by the Administration, which is in no way associated with gambling.

5. The minimum age of the User is 14 years (Federal Law No. 436-ФЗ). If you are under 14, use of the Server is permitted only with the written consent of a legal representative.

6. By accepting this Agreement, the User confirms their legal capacity and the right to enter into this Agreement. The Administration is not obliged to verify the information provided by the User during registration.

7. If the User for any reason disagrees with the terms of this Agreement, they must cease further use of the Website and Services of the “Age of Astir” project.

4. User’s Rights and Obligations

4.1. The User shall:

1. Comply with the legislation of the Russian Federation and the terms of this Agreement.
2. Protect the confidentiality of their account credentials and be responsible for all actions performed under their account.
3. Bear full responsibility for any actions taken through the Service, including those violating this Agreement, the laws of the Russian Federation, or the rights and lawful interests of third parties.
4. Provide accurate information, including a valid e-mail address, to access certain Service features.
5. Fully compensate any damage caused to the Administration, the Project, and/or other rights holders due to violations of this Agreement, the laws of the Russian Federation, or third-party rights, either voluntarily or by court order, including losses, legal defense costs, and other documented expenses.

4.2. The User has the right to:

1. Use the functionality of the Service provided by the Administration free of charge.
2. Make voluntary Donations to the Administration on a gratuitous basis.
3. Send suggestions, feedback, and complaints regarding the operation of the Service to support@ageofastir.com.

4.3. The User is prohibited from:

1. Using software tools not provided by the Administration to emulate, automate, modify, or otherwise interfere with the operation of the Services.
2. Performing any actions aimed at altering, interfering with, disabling components, or compromising the integrity of the Game Client.
3. Interfering with the operation of the Server, including its network infrastructure, databases, or related systems.
4. Modifying, decompiling, disassembling, reverse-engineering, or otherwise analyzing the Game Client’s code or its components.
5. Bypassing, disabling, tampering with, or otherwise overcoming built-in protections and restrictions in the Game Client or any other project software.
6. Extracting, copying, modifying, distributing, publishing, or otherwise using any Game Client resources (including graphics, audio, animations, scripts, configuration files, and other elements) outside the context of gameplay.
7. Using tools, scripts, or other means to access the source code, data structures, algorithms, or network protocols used in the Game Client.
8. Creating, using, or distributing software or hardware designed to replicate, copy, emulate, or imitate the Game Client or Server.
9. Using code, visual, audiovisual, or other technical assets contained in the Game Client to create independent projects, software products, games, or commercial software.
10. Distributing via the Service or otherwise transmitting any information, materials, or files that violate the laws of the Russian Federation, third-party rights, or generally accepted standards of morality and decency.
11. Deriving commercial benefit from the use of Game Content, or transferring, alienating, selling, or exchanging Game Content for payment or other consideration.
12. Taking any actions aimed at destabilizing the Server, including, but not limited to, conducting DDoS attacks, flooding, network scanning, overload attempts, or other forms of sabotage.

5. Administration’s Rights and Obligations

5.1. The Administration may at any time, without prior notice to the User:

• Fully or partially suspend, modify, or terminate the operation of the Server and/or other Service components, including performing maintenance, updates, or a “wipe” (complete deletion of User data).
• Amend this Agreement and/or publish a new version on the project website. Continued use of the Service by the User constitutes acceptance of the updated Agreement.
• Restrict, suspend, or terminate the User’s access to the Service for violating this Agreement, Russian Federation law, or for other grounds provided herein.
• Delete, modify, or limit access to any Game Content, as well as temporarily or permanently block or delete User Game accounts at its sole discretion, without compensation or explanation.

5.2. Administration’s Obligations and Limitation of Liability:

The Administration uses reasonable efforts to ensure availability and stable operation of the Service but does not guarantee uninterrupted, error-free, or continuous functionality. The Administration is not liable for technical failures, temporary unavailability, data loss, or other consequences arising from third-party actions or objective limitations of information systems.

6. Intellectual Property

1. All exclusive rights to the software, Game Client, Server, website, design, game mechanics, visual, audio, and textual materials, as well as Game Content of the “Age of Astir” project, belong solely to the Administration, unless otherwise expressly stated.
2. No provision of this Agreement grants or transfers any intellectual property rights to the User. Use of intellectual property is permitted only within the scope of the Service’s functionality and solely for personal, non-commercial purposes.
3. The User acknowledges and agrees that:
   • They hold no proprietary or other rights to characters, items, in-game currency, achievements, accounts, or any other Game Content components.
   • These elements are not objects of sale, exchange, or transfer and have no monetary or market value.
   • Any use, reproduction, copying, publication, distribution, display, or modification of Game Content, as well as attempts at commercialization, without the Administration’s written permission is prohibited.
   • Creating derivative products, clones, mods, fan games, or other applications based on the Service, Game Client, or its elements is prohibited without the Administration’s explicit written consent.
4. It is prohibited to extract, copy, analyze, decompile, reproduce, distribute, or otherwise use elements of source code, client logic, interfaces, visual resources, scripts, configurations, or other software components to develop similar or competing solutions.

7. Donations and Bonuses

1. All funds received from Users are considered Donations (Art. 582 of the Civil Code of the Russian Federation) and are directed to the development of the Administration’s open-source projects.
2. Donations are final and non-refundable under any circumstances, including Server shutdown.
3. Issuance of Bonuses is voluntary and charitable, provided “as available” and does not constitute a reciprocal obligation of the Administration.
4. Receipt of a Bonus does not confer ownership or any other property right; a Bonus may be modified or revoked at any time without compensation.
5. The User is solely responsible for the accuracy of payment details when making a Donation and for tax reporting in their jurisdiction; the Administration is not the User’s tax agent.
6. Liability cap of the Administration related to Donations and Bonuses is limited to the actual amount of Donations made by the User in the last 12 months, but not exceeding 5,000 rubles.

8. Personal and Technical Data

1. Consent to Processing. By using the Service, the User grants the Administration the right to process their personal data (e-mail, IP address, etc.) and technical device data (CPU/GPU model, RAM capacity, OS version, peripherals).
2. Purposes of Processing: to ensure the operation of the software and Server, analytics, fraud and cheat protection, and performance improvement.
3. Data is not shared with third parties, except as required by law or to protect the Administration’s lawful interests.
4. The User may withdraw consent by sending a request to support@ageofastir.com; access to the Server will then be terminated, and data may be deleted if no legal grounds for retention exist.

9. Limitation of Liability

1. The Server, Game Client, and content are provided “as is” (AS IS) without any express or implied warranties.
2. Total liability of the Administration for any User claim is limited to the lesser of:
   • the amount of the User’s Donations in the last 12 months;
   • 5,000 rubles.
3. The Administration is not liable for:
   1. indirect, incidental, or punitive damages, lost profits;
   2. moral damages;
   3. loss or damage of Game Content due to wipes, failures, or third-party actions;
   4. Server unavailability for reasons beyond the Administration’s control.
4. The User shall indemnify the Administration for losses and expenses arising from third-party claims caused by the User’s actions or content (indemnity clause).
5. Statute of limitations: the User may file a claim in court within 6 months from the date they knew or should have known of the violation; after this period, claims are irrevocably forfeited.

10. Force Majeure

The parties are released from liability for full or partial non-performance of obligations caused by force majeure events: natural disasters, military actions, acts of government authorities, Internet outages, power failures, mass cyberattacks, and other circumstances beyond the parties’ control.

11. Pre-trial Procedures and Dispute Resolution

1. The User must send a written claim to support@ageofastir.com before going to court.
2. The Administration will review the claim and send a reasoned response within 30 calendar days of receipt.
3. Failure to follow the pre-trial procedure is grounds for returning the lawsuit without consideration (Art. 135 of the Civil Procedure Code of the Russian Federation).
4. All disputes not resolved pre-trial shall be adjudicated in the court at the Administration’s place of residence (unless otherwise required by mandatory law).

12. Final Provisions

1. The invalidity of any provision of this Agreement does not affect the validity of the remaining provisions. If any provision is declared invalid, the parties shall perform the Agreement to the greatest extent possible.
2. The Administration may unilaterally amend or supplement this Agreement and other regulatory documents posted on the project website without prior notice to the User.
3. The new version of the Agreement takes effect upon its publication on the project website, unless otherwise specified. Continued use of the Service constitutes full and unconditional acceptance of the changes.
4. The User undertakes to independently and regularly review the current version of the Agreement and other regulatory documents posted on the project website.
5. The User confirms that they have read this Agreement, understand its contents, and agree to its terms without exception.
